Terms and Conditions

1. INTERPRETATION

1.1 In these Conditions the following words have the following meanings:
“Customer” means the firm, organisation or company who purchases services from B-EMC.

1.2 “B-EMC” refers to Brighton EMC, an EMC test facility, owned and managed by the following:

1.3 “Contract” means any contract between a B-EMC and the Customer for the sale and purchase of Services, incorporating these Conditions.

1.4 “Services” means any services agreed in the Contract to be supplied by a Nominated B-EMC Representative.

2. APPLICATION OF TERMS

2.1 Contract will be on these Terms and Conditions to the exclusion of all other terms and conditions (including any terms and conditions which the Customer purports to apply under any purchase order, confirmation of order, specification or other document).

2.2 No terms or conditions endorsed upon, delivered with or contained in the Customer’s purchase order, confirmation of order, specification or other document will form part of the Contract simply as a result of such document being referred to in the Contract.

2.3 Any variation to these Conditions and any representations about the Service shall have no effect unless expressly agreed in writing between the authorised Representatives of the Customer and a Nominated B-EMC Representative.

2.4 No booking placed by the Customer shall be deemed to be accepted by a Nominated B-EMC Representative until a written acknowledgement of order is issued by the same.

2.5 Any booking is made on the basis that no contract will come into existence until the Nominated B-EMC Representative despatches a confirmed booking acknowledgement to the Customer.

2.6 All transactions are business to business transactions.

3. HEALTH & SAFETY

3.1 The Customer will abide by all site rules and health and safety requirements imposed upon them while on B-EMC premises.

3.2 The Customer will not carry out any work on B-EMC premises or using B-EMC equipment unless accompanied by an authorised Nominated B-EMC Representative.

3.3 Nominated B-EMC Representative will not alter, manipulate, set up, operate or otherwise interfere with the Customer’s product.

4. AVAILABILITY

4.1 B-EMC premises are available for booking for a minimum of 2.5 hours.

4.2 The premises may not be booked for more than 8 hours in any one day.

5. BOOKING – CREDIT CARD PAYMENTS

5.1 Bookings are made via the booking portal at:
https://bookings.brighton-emc.co.uk

5.2 All bookings must be accompanied by credit card details and contact information.

5.3 The Customer will pay 50% of the cost when the order is more than 14 days from the first date of the booking.

5.4 If 50% is paid when placing the order, B-EMC shall contact the Customer by email 14 days before the booking date to request that the remaining 50% is paid to confirm the test slot.

5.5 Should the Customer fail to make the remaining 50% payment to confirm the test slot. The booking will be cancelled, the Customer will not receive a refund for the original 50% payment.

5.6 The Customer will pay 100% of the cost when the order is less than 14 days from the first date of the booking.

5.7 All orders are subject to approval. Once approved B-EMC shall contact the Customer to confirm the booking.

6. BOOKING – BACS PAYMENTS

6.1 Bookings are made via the booking portal at:
https://bookings.brighton-emc.co.uk

6.2 BACS payments require the Customer to pay 100% of the cost 7 days before the first date of the booking.

6.3 If the Customer places the order within 7 days of the first date of the booking, BACS payments require the Customer to pay 100% of the cost the same day the order was placed.

6.4 B-EMC shall contact the Customer by email to confirm receipt of the order and the final payment date (i.e. date to be paid by).

6.5 All orders are subject to approval. Once approved B-EMC shall contact the Customer to confirm the booking.

7. CANCELLATION

7.1 In the event the Customer cancels or postpones a previously confirmed and acknowledged booking, the Customer shall pay the following charges (together with VAT):

7.2 “Weeks” refer to the normal working week of Monday to Friday and excludes weekends and public holidays.

7.3 Less than  4 weeks’ notice– 25% of contract value

7.4 Less than 3 weeks’ notice – 50% of contract value

7.5 Less than 2 weeks’ notice – 75% of contract value

7.6 Less than 1 weeks’ notice – 100% of contract value

7.7 If the costs and resources can be defrayed by another project; B-EMC may (in its entire discretion and without any obligation or liability to do so) decide to reduce or waive any charge.

8. LIABILITY

8.1 All tests are specified by the Customer and carried out at the Customer’s risk.

8.2 The Customer’s product and equipment is at the Customer’s risk at all times while on B-EMC premises and no liability is accepted by B-EMC for any loss however caused.

8.3 Test results relate only to the equipment tested and must not be used to claim product endorsement by B-EMC.

9. DECISION RULES RELATING TO MEASUREMENT UNCERTAINTY

Conducted Emissions

The expanded measurement uncertainty for the measurement instrumentation is within the criterion specified by CISPR. This is determined by the test laboratory uncertainty being less than the value for UCISPR given in CISPR 16-4-2. Therefore, no compensation is required to the actual measured level in determining compliance with the applied limit.

Radiated Emissions

The expanded measurement uncertainty for the measurement instrumentation is within the criterion specified in CISPR 16-4-2 for 3m measurement with a non-tilting antenna. This is determined by the test laboratory uncertainty being less than the value for UCISPR given in CISPR 16-4-2. Therefore, no compensation is required to the actual measured level in determining compliance with the applied limit.

Conducted Radio-Frequency Immunity Test

No corrections to the selected test levels are to be made to factor the uncertainty budget for this test, as instructed by the reference standard (EN 61000-4-6), hence field strength will be as reported.

Radiated Radio-Frequency Immunity Test

No corrections to the selected test levels are to be made to factor the uncertainty budget for this test, as instructed by the reference standard (EN 61000-4-3), hence field strength will be as reported.

Electrostatic Discharge

The test is applied using proprietary equipment that meets the requirements of EN 61000-4-2. The calibration results must be within the specified limits of the EN 61000-4-2 standard (tolerances are not reduced by measurement uncertainty). It has been demonstrated through traceable calibration that the ESD generator meets the specified requirements in the standard with at least a 95% confidence level.

10. CONFIDENTIALITY

10.1 B-EMC and the Customer both undertake to keep confidential all matters relating to the
provision of the testing services and any information obtained while on the other’s premises to the
extent a reasonable person would ordinarily regard these as being commercially sensitive or
confidential. For the avoidance of doubt, matters relating to the provision of the testing services
include every material aspect of the contractual relationship between B-EMC and the
Customer, including (but not limited to) products tested, evaluations carried out, methods used,
and the nature and contents of any reports.

10.2 In fulfilling their obligations under this clause, B-EMC and the Customer shall safeguard
each other’s information by exercising at least the level of care and diligence it applies to
similar information of its own.

11. STORAGE

11.1 Storage of customer equipment is available on request for items awaiting test or following the completion of testing. B-EMC will store customer equipment in a designated and access-controlled area in our Test Facility however, storage of customer equipment is at the customer’s risk and B-EMC will not accept any responsibility for damage or loss of customer equipment stored.

11.2 If customer equipment is not collected within 30 days after the completion of testing, the Test Facility will contact the customer to confirm if disposal or return transport is to be arranged.

11.3 B-EMC do not provide transport services for the receipt or return of customer-owned items for testing. The customer is responsible for arranging and paying for transportation of their items.

11.4 Only in exceptional circumstances where a customer has future related project work, will the 30-day storage limit be extended.

12. CUSTOMER’S PROPERTY

12.1 The Customer acknowledges that it has been advised that every testing process carries an inherent and unavoidable risk that the product or equipment to be tested may be damaged or destroyed and that it is the Customer’s responsibility to insure and otherwise protect its property prior to it being tested.

12.2 Under no circumstances will B-EMC be responsible for any additional costs or damages, including consequential damages and indirect costs or losses, resulting from destruction or loss of the Customer’s property.
